Terms & Condition - Distance contract and right of withdrawal
ELITE GROUP SIA (reg. no.: 40203165407), legal address Cēres 10A, Riga, LV-1058, represented by a member of its board, on the one hand, hereinafter referred to as the Seller, and the person who places an order on the Mobile Terraces website www.mobileterraces.com, www.mobilasterases.lv and has confirmed that they agree to the terms of this agreement, hereinafter referred to as the Buyer, on the other hand, conclude the following Agreement:
The Seller undertakes to sell and deliver the goods to the Buyer in accordance with the Buyer's order.
Delivery and payment procedures
The Buyer places an order for goods through this website, indicating the type and quantity of goods to be ordered. The Buyer has the option of paying for the goods using the payment tools built into this website (payment by card, internet banking and payment service) or by paying the invoice prepared by the Seller and sent to the Buyer by e-mail corresponding to the order. If the Buyer chooses to make a payment by transfer, the Seller automatically prepares and sends to the Buyer by e-mail an advance invoice corresponding to the order, hereinafter referred to as the AR, which is an integral part of this distance contract. AR is prepared electronically and is valid without a signature. After receiving payment for the AR, a final invoice prepared in accordance with the laws and regulations of the Republic of Latvia and European Union standards is sent to the Buyer electronically. The Buyer is responsible for any additional costs that may be associated with the selected payment method.
The Seller ensures the delivery of the goods within 7 days of receipt of payment for the goods, coordinating the delivery time with the Buyer. The delivery price is calculated individually for each customer and is clearly displayed on the invoice or on the screen before payment is made.
Right of withdrawal
The Buyer has the right to refuse the goods within 14 calendar days from the moment of receipt of the Goods by sending a letter of refusal to the Seller to info@mobilasterases.lv . The Seller sends the letter of refusal form to the Buyer by e-mail at the Buyer's request. The Buyer is obliged to return the goods to the Seller within 7 days after sending the letter of refusal, returning it to our legal address - Cēres iela 10A, Riga. All expenses incurred in connection with sending the goods back to the Seller are covered by the Buyer. The Buyer cannot exercise the right of withdrawal if:
▪ the ordered goods cannot be returned due to their nature, or they are perishable or quickly expendable;
▪ the ordered goods are made specifically for the Buyer according to an individual order;
Article 12, Part 6 of the Consumer Rights Protection Law of the Republic of Latvia states that "the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Buyer to exercise the right of withdrawal or to withhold compensation in the event that the goods are damaged due to careless handling of the goods during use or failure to follow the relevant instructions. We will return your payment no later than 14 days from the date on which we receive the returned Goods. We will use the same means of payment that you used for the Order, and you will not be charged any fees for such a return.
Data processing
By entering the required information when placing an order, the Buyer confirms that he/she has read and agrees that the data provided by him/her is used so that the Seller can accept the Buyer's order and deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees that notifications related to the processing of the Buyer's order will be sent to the specified e-mail address.
Dispute resolution procedure
The Parties shall resolve any dispute or disagreement that arises during the performance of the Agreement through mutual negotiations, but if the dispute or disagreement cannot be resolved within 30 (thirty) calendar days, then they shall be resolved by the competent court of the Republic of Latvia in accordance with the laws and regulations of the Republic of Latvia.
